RELEASE, ASSUMPTION OF RISK AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT.
C.A.S. Iberia, INC., a Tennessee corporation d/b/a CAS Iberia, wholesales swords, knives, and related merchandise (collectively "Merchandise") only to a company or organization (collectively “Purchaser”) that can legally purchase and own such items in the particular jurisdiction where the Purchaser is based. The purchase of such Merchandise, whether by phone, fax, mail, or over the internet legally binds the Purchaser, its heirs, assigns, transferees and personal representatives as follows:
When the Purchaser orders and purchases Merchandise from CAS Iberia, it represents that the Merchandise can be purchased and owned in the country, state, county and/or city in which the Purchaser is based. By offering Merchandise for sale, CAS Iberia does not represent or warrant that any Purchaser may legally purchase, own or possess the Merchandise ordered. The Purchaser is advised to CHECK ITS LOCAL LAWS.
Swords, Knives, and related CAS Iberia Merchandise may be dangerous, even deadly, if used improperly, negligently and/or illegally. When a Purchaser purchases Merchandise from CAS Iberia, it agrees that any and all re-sales of the purchased Merchandise will be made in a safe and legal manner, consistent with all applicable laws, recognized safety rules and common sense. The Purchaser also warrants that it will do all that is reasonable to keep swords, knives and related Merchandise out of the hands of minors and immature individuals.
When a Purchaser purchases Merchandise from CAS Iberia, it agrees to assume all risks related to and/or arising from the ownership and use of the Merchandise and agrees to indemnify and hold CAS Iberia harmless from any and all claims brought by any person or entity against CAS Iberia related to and/or arising from its ownership and/or use of the Merchandise.
